2. WHAT DATA DO WE COLLECT ABOUT YOU
Personal Data means any information capable of identifying an individual. It does not include anonymised data.

At Victoria Fenton Healthcare Ltd. we collect medical data; information about your health and genetic and biometric data. There may be times we collect other sensitive data about you, where you directly provide us with this. Other sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership. We do not explicitly collect any information about criminal convictions and offences, though these may be stored in your record within documentation created for your use only.
We require your explicit consent for processing sensitive data, so when you submit your details we ask you to confirm your consent to this processing. We treat sensitive data under the legislation of Special Category Data. (It should be noted that these areas of legislation are still being determined by governing bodies and under our membership of the ICO will keep up to date with any further policy making in this field.)
In addition, all laboratories and third parties that Victoria Fenton Healthcare Ltd. chooses to work with are vetted by ourselves to comply with stringent data protection, privacy and confidentiality laws. Companies not based in the UK are selected carefully to comply with European GDPR rules.
Where we are required to collect personal data by law, or under the terms of the contract between us, and you do not provide us with that data when requested, we may not be able to perform the contract (for example, to deliver goods or services to you). Social media and internet based advertising – Victoria Fenton Healthcare Ltd. utilises social media in its marketing and advertising. When you interact with Victoria Fenton Healthcare Ltd. related social media content, for example, “liking” content on our Facebook page, such interaction may allow us to collect your IP address or the page you are visiting from. We reserve the right to use LinkedIn, Facebook, Twitter, Instagram and YouTube advertising services and as such there are tracking codes such as a Facebook Pixel installed on our Site so that we can manage the effectiveness of these campaigns. We do not store any personal data within this type of tracking.

These cookies allow the ad server to recognise your computer each time they send you an online advertisement to compile non personal identification information about you or others who use your computer. Victoria Fenton Healthcare Ltd. will not sell or rent your personally identifiable information, gathered as a result of filling out the Site newsletter sign up forms, to anyone. Victoria Fenton Healthcare Ltd. may share generic aggregated demographic information not linked to any personal identification information regarding visitors and Users with the business partners, trusted affiliates and advertisers for the purposes outlined above. We use a third party provider, to process your subscription and deliver our newsletter. We gather statistics around email opening and clicks using industry standard technologies to help us monitor and improve our e-newsletter. You can unsubscribe to general mailings at any time by clicking the unsubscribe link at the bottom of any of our emails or by emailing us. Where you opt out of receiving our marketing communications, this will not apply to personal data provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.

6. INTERNATIONAL TRANSFERS
We share your personal data within our company which involves transferring your data outside the European Economic Area (EEA).
Countries outside of the European Economic Area (EEA) do not always offer the same levels of protection to your personal data, so European law has prohibited transfers of personal data outside of the EEA unless the transfer meets certain criteria.
Many of our third parties service providers are based outside the European Economic Area (EEA) so their processing of your personal data will involve a transfer of data outside the EEA.

7. DATA SECURITY
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know such data. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
Access to personal data and information
Only practitioners registered with Victoria Fenton Healthcare Ltd. have access to our systems and data storage. We use an accredited, centralised, third-party practice management system (Healthpath Pro) bound by UK law with regard to GDPR, data protection, privacy, confidentiality and storage. Computers which have access to these systems are password and/or fingerprint protected.
Only practitioners assigned to specific patients have access to specific patient data. In such a way, whilst we are an integrated team, your data is only shared with other practitioners with your express permission (in writing, via email).
We are a paperless practice. All of our data is held electronically. We store no paper records and in cases where information is received in paper form it is digitised and the paper copy securely destroyed.
We will store you personal data in line with all laws pertaining to the treatment of medical data. Please find the guidance that we follow linked here.
Our Site is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our Site as safe as possible. We do not use Malware Scanning.
All sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. When you are on a secure page, a lock icon will appear in the address bar of your browser.
We implement a variety of security measures when a User places an order, hires us, enters, submits, or accesses their information to maintain the safety of your personal information. All transactions are processed through a gateway provider (PayPal or Stripe) or a bank transfer and are not stored or processed on our servers. Payment and login information are encrypted.
Non-sensitive details (e.g. your name, email address) are sent normally over the internet and this can never be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information you transmit to us and you do so at your own risk.

Deletion of personal data
Under GDPR regulations, any individual has a right to request erasure of their information at any time. However, the expert view is that medical requirements take precedence over GDPR rights to erasure. Therefore, notable exceptions include:

the provision of health or social care
the management of health or social care systems or services
Victoria Fenton Healthcare Ltd. is a healthcare service provider: medical and healthcare data is deemed as exempt from deletion or erasure upon patient request in the majority of cases until retention schedule limits are met.
At Victoria Fenton Healthcare Ltd. we voluntarily comply with the NHS Records Management Code of Practice for Health and Social Care 2016. Within these detailed retention schedules, we are bound to retain patient information for 8 years.
Our records are all electronic and our systems allow for metadata sub data records to be retained so deletion takes place in accordance with an 8 year retention policy.
By law, we have to keep basic information about our clients/customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being clients/customers for tax purposes.
In some circumstances – notably those in which you have provided data which is not medical in nature – you can ask us to delete your data: see below for further information.
In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes. However, at Victoria Fenton Healthcare Ltd. we have committed to asking your express permission before utilising your data in this way.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.
